Human Rights and Statelessness

Statelessness occurs for a variety of reasons including discrimination against minority groups in nationality legislation, failure to include all residents in the body of citizens when a State become independent (State succession) and conflicts of laws between states.

UNESCO leads the global Education for All (EFA) movement, aiming to meet the learning needs of all children, youth and adults by 2015.
CDROM content: The United Nations High Commissioner for Refugees is mandated to lead and co-ordinate international action to protect refugees and resolve refugee problems worldwide. Its primary purpose is to safeguard the rights and well-being of refugees.

Prevention of Statelessness:
  • Calls on States to facilitate birth registration and issuance of birth or other appropriate certificates as a means to providing an identity
  • Encourages States to consider examining their nationality laws and other relevant legislation
  • Notes that statelessness may arise as a result of restrictions applied to parents in passing on nationality to their children
  • Encourages States to seek appropriate solutions for persons who have no genuine travel or other identity documents
  • Calls upon States Parties to the Protocol to Prevent, Suppress and Punish Trafficking in Persons, Especially Women and Children and the Protocol against the Smuggling of Migrants by Land, Sea and Air.
